Land for HDB: what restrictions are in place in Ukraine during wartime.


Combatants and persons equated to them have priority in obtaining land
People who participated in combat operations, as well as persons equated to them, have primary rights to receive land for construction, agricultural production, and other purposes. However, during martial law in Ukraine, there are several restrictions regarding land operations.
Lawyer Larysa Velychko told 24 Channel that the Land Code of Ukraine was amended in points 5 and 27 of section X. According to these changes, during the martial law period, it is prohibited to transfer land from state and communal property to private ownership for free.
This is regulated by the Law of Ukraine 'On Amendments to Certain Legislative Acts of Ukraine on the Restoration of the System of Registration of Lease Rights for Agricultural Land Plots and Improvement of Legislation on Land Protection', which came into effect on November 19, 2022.
These restrictions also apply to Ukrainian servicemen who have the status of combatants.
'It was prohibited to transfer land from state and communal ownership to private ownership for free, as well as to issue permits for the development of land management documentation for the transfer of land for free and the development of such documentation', the lawyer explained.
It is important to note that these restrictions do not apply to the free transfer of land plots into private ownership:
- to property owners (buildings, structures) located on such plots;
- to Ukrainian citizens who were granted land plots for use before the Land Code came into effect (i.e., before January 1, 2002).
