According to Ukrainian legislation, it is possible to legally decline mobilization if there are grounds for deferment. These are all defined in the law 'On Mobilization Preparation and Mobilization', or if a person has a formal reservation at the workplace.

How to Legally Avoid Mobilization

Lawyer Kateryna Anishchenko explained the details of the legal opportunity to decline mobilization, stating that the categories of individuals eligible for deferment are clearly specified in Article 23 of this law.

They include:

  • persons who are under reservation during mobilization and wartime;
  • men and women who support three or more children under the age of 18;
  • persons with disabilities or those who have dependent minor children with disabilities.

Persons who are recognized as unfit for military service due to health reasons and are not included in military records are also exempt from mobilization. Women cannot be forcibly mobilized and have the right to voluntarily enlist in military service.

The lawyer emphasized that the right to deferment and a properly formalized deferment are different legal statuses.

Having the right to deferment does not guarantee protection from mobilization without official registration. Kateryna Anishchenko urged citizens to exercise their legal right to deferment and ensure it is formally registered.
